There are three Powers
1. Executive Power
2. Legislative Power
3. Constituent Power - Constituent power is of five types.
The power that can amend the Constitution is known as Constituent power.
3a. Original Constituent Power - Power which described in words and laws is framed
3b. Ancillary Constituent Power - Article 238 - Develop the structure to bring the states to a level of development - It includes Article 306 (commerce power), Article 317, and Article 370 to protect people.
It can be called ancillary Constituent power.
4. Amendatory constituent Power is a constituent power.
Article 370 - It cannot be decided on the basis of sentiments. The Constitution of India shall decide about the relation between the Indian Constitution and the JK Constitution. There is no line in the JK constitution that the JK constitution will not accept the Indian constitution. Debate on Article 370 was not allowed as neighboring states would have taken use of this discussion. Great leaders are interested in their nation. Books wrote that war was going on between India and Pakistan. All three generals in India were British and in Pakistan were British. They divided India. Who fought the war in JK? The book "Mutiny" explains. Raiders did not come to Srinagar. It was a war of a different kind. Mount Betton was made the commander of the Army. When you read the Constitution and Article 370 then you can understand why and what were the circumstances during that time? The same powers, that were dividing India, were the powers in the United Nations.
Problems were on both sides. The basic system of the federal system is intact.
5. If India acquires some other territory, then Article 2 is applied. It is a continuous process. It cannot be questioned how Hyderabad was occupied. Article 368 is an amendatory power to Constituent power. Article 368 path means that parliament should pass the law by a two-thirds majority.

1. Rahul Gandhi is sinister. He lies, repeatedly, in the hope that it will be accepted, at some point, as the truth. Maybe, the Congress should start acknowledging the misdeeds of Jawaharlal Nehru, when it comes to compromising our territorial integrity.
Pakistan has been in illegal and forcible occupation of approximately 78,000 sq kms of Indian territory in Jammu and Kashmir. China continues to be in illegal occupation of approximately 38,000 sq kms in the Indian UT of Jammu and Kashmir. In addition, under the so-called ‘Sino-Pakistan Boundary Agreement of 1963`, Pakistan illegally ceded 5,180 sq kms of Indian territory in Pakistan Occupied Kashmir to China.
The above response was tabled on the floor of the Rajya Sabha on 22/11/2012, when UPA was still in power.
All of the above were lost as a consequence of Nehru’s delusional foreign policy, one which prioritised his own self image over national interest…
Nehru was so subservient to the Chinese that he even rejected the offer to include India in the UN Security Council. Here is what he said, “Suggestions have been made by the United States that India should take China's place in the Security Council. We cannot of course accept this as it means falling out with China and it would be very unfair for a great country like China not to be in the Security Council.”
In 2013, former foreign secretary and National Security Advisory Board chairman Shyam Saran submitted a report to the PMO in August 2013. Dr Manmohan Singh was still the Prime Minister.
2. As per the report:
1. China's People's Liberation Army (PLA) had "incrementally" occupied nearly 640 square km of area on the Line of Actual Control (LoAC) in Ladakh in 2013.
2. According to the report, patrolling limits set by incremental PLA area denial in eastern Ladakh region of Jammu and Kashmir had now become the de facto LoAC.
3. The resulting area denial was effectively a loss of 640 sq km across three sectors in Depsang, Chumar and Pangong Tso.
4. It also said that Indian troops were no longer able to access at least four points on the patrol line, thereby denying an area earlier accessible to them. Moreover, after PLA incursions in April and May of 2013, Depsang Bulge was no longer accessible to Indian forces.
But UPA failed to register a strong protest with the Chinese. They in fact tried to cover up their pusillanimity by indulging in hubris.
The nation still pays a horrific price for Congress misdeeds that started with Nehru and continued till Manmohan Singh.
Not an inch of Indian land has been lost since 2014. If at all, India has, for the first time, responded to any aggression on the boundary, with never seen before ferocity.

This incident created fear among Kashmiri Hindus, exacerbated by the failure to capture Taploo’s killers. Subsequent targeted killings of Hindus deepened this sense of insecurity." 5. Listen to the Video about the concurrence required of the state. CJI differentiates between concurrence and sovereignty of the state. Once you agree that the constitution of India is accepted then the sovereignty of Kashmir is completely ceded to the dominion of India (11:12). Advocate agreed that Kashmir ceded with India but given the background of discussions at that time, concurrence is required for list one and three. It is not a matter of routine. Let us go to the next point.
Integration has taken place once accession is agreed upon. Advocate thinks that it has a context and with reference to context one cannot diverge. The surrender of sovereignty was absolutely clear. (1;00 onwards). Very interesting video.

1. Gulam Nabi Azad said that Kashmir belonged earlier to Kashmiri Pandits. Shaikh Abdullah also wrote in his biography that his great-grandfather was Kashmiri Hindu. Mrs. Bhutto also wrote that her great-grandfather was also Hindu. So Muslims are either converted from Hindus or migrated from other parts of the world. The Muslim religion is hardly 1500 years old, while the Hindu religion is more than 5000 years old. In other words, India belongs to Hindus.

P Chidambaram was the Home Minister/ Finance Minister and close aide of Sonia Congress when INC India devalued the moral value of India by being corrupt. Money was received and given openly to heads of the institutions and government overlooked this giant snake and white ant. Corrupt practices prevailed from peons to the central ministers, though a few were not corrupt. But if the ruling party is closing its eyes and overlooking the corrupt practices in the judiciary, then it is assumed that Sonia INC was corrupt. Corruption cases were delayed to help the corrupt.
P. Chidambaram was unluckily at that time of the history with INC and his family also washed their hands in the flowing river of Ganga. Assuming it is correct, then his article published in the Indian Express loses its significance. I am of the opinion that P. Chidambaram is a very intelligent legal and senior parliamentarian. He must understand and wash his sins and reboot his attitude to serve the people of India and try to guide and build a new India. In other words, help Narender Bhai Modi.
I agree with P. Chidambaram that the authoritarian system s full of disadvantages. But sometimes it is necessary as Indira Gandhi declared an emergency to tame the wild elephant movement of Jaiprakash Narayan. Young Turks Jagjeevan Ram, Bahu Guna, and Chandra Shekhar opposed Indira Gandhi.
Consider the motives behind new laws passed by the parliament. Think beyond P. Chidambaram and then write.

P Chidambaram must come out from corrupt practices by accepting the mistakes committed and change his moral values.
29 July 2023The problem is not POK, but POK is supported and occupied by China. Pak is a Muslim country and Turkey supports Pakistan. The USA does not want that India should be more powerful than China, for a strong and powerful India may be a challenge to the Unipolar world. The USA wants that India and China should balance each other. Russia is already balanced with the European Union. Ukraine war is an example.
What India can do to occupy POK? The only way is a peaceful method. That is hold elections in POK along with parliament elections in India. Terrorists may disturb the POK and IOK elections. Elections of India in Kashmir should be held under United Nations supervision. POK is part of Indian Kashmir. Pakistan is worried about this. Modi has already told to Putin that war is not a solution in the existing polar system. War is fought indirectly by CIA/KGB/MI/ISI/RAW etc. Cyberwar is fought nowadays. India must prepare for war with China so that again new Buddha may take birth in India.
I advocate the unity of Russia, China, and India for peace and prosperity in Asia.

BBC suggests seven solutions and informs why these may not be accepted. Jaipal Datta wrote on Facebook on 10 July 2019 " BBC informs seven solutions to Kashmir problem. Pakistan is not accepting the 1974 Shimla agreement with India. It is not the first time in a Muslim country. Israel experienced the same many times when Muslim countries violated agreements negotiated and accepted. War is also not a solution.
The solution is only to declare war on terror and India must act to curb the terror activities. Muslims in India must understand and cooperate with the Indian government. Kashmir must agree to the removal of articles 370 and 35A and must welcome Kashmiri Pandits and other Hindu communities from different parts of India as a welcome gesture to stop more blood flowing in the Chenab river".
If Kashmir does not accept this then Muslims must decide to compel Pakistan and Kashmir to be secular.
According to John Rawls some people and peoples are rogue and well-ordered peoples must consider rogue states carefully.

Congress is dividing the country and creating a situation of conflict. Muslims in Kashmir must understand that America has withdrawn from the Iran Nuclear deal. Israel may attack Iran. The world situation is changing very fast. Muslims are known as terrorists due to IS and Taliban due to no fault of the majority. Facts can not be overlooked.
Is Kashmir ready to become Syria? Yesterday's warning of Zee News is alarming. Aligarh University still supporting Jinnah. Students did not remove the photo of Jinah who divided Hindustan for his selfish ends. The two Nation Theory of Jinah already failed. Pakistan killed many Muzahirs who migrated from East Uttar Pradesh to Pakistan. There was no hue and cry by Muslims of India. There was no hue and cry when Kashmiri Pandits migrated.
This time war is not for territory or resources. It will be to eliminate religion of violence and propagate democracy in nondemocratic countries.
Corruption leads to terror as corrupt law and order executives including corrupt judiciary fail to give justice to the people. Government or ruling party must take action to protect persons and property. Politicians must first fight corruption and then take action against misguided terrorists, who took this profession by compulsion/injustice of the society.
The corrupt political system created terrorists and fraudulent activities in India. Leadership must take responsibility and help now at least to create New India. Corrupt leaders, bureaucrats, advocates, judges, and media must accept gracefully the mistakes committed and help Modi, Yogi, and other leaders to improve the system.
Each political leader creates confusion and thinks of votes in a democracy. Statesman thinks about the next generations. Philosophers and many academicians try to support elites and create confusion in theories to confuse societies. But the fact remains we live in a society and we all are human beings. We have to live and earn money. We act as per our intuition. Some are selfish and criminals. Some are altruists and saints. This is society good or bad, liberal and non-liberal.
Dr. Farukh Abdulla scolded the media when the media asked useless questions and doubted the Indian integrity of Dr. Farukh Abdulla. I agree with Dr. Farukh Abdulla that these media anchors create problems and knowingly or unknowingly divide the country into communal lines. The media puts words in the mouth of the interviewee and then twists the words in favor of the frame for which they earn their livelihood. Media acts as presstitutes.
Dr. Farukh Abdulla is right when he confirms that POK or IOK can be resolved through negotiations only. He informs that many times we were about to conclude the issue but circumstances did not help to resolve. It was sad that India released terrorists to save 200 persons from the aircraft including the daughter of a politician (father of Mehbooba Mufti)
